Canadian Immigration -

Canadian Work Visa (Permit)

The Canadian Work Permit Process Explained:

Before you as a potential employee can lodge an application, the following is required:

Canadian Immigration policy dictates that, a work permit can only be applied for after the steps below have been taken:

  • An employer must first offer you a job
  • Human Resources Development Canada (HRDC) must provide a labour market opinion or 'confirmation' of your job offer

To Qualify for a Canadian Work Visa (Permit):

Along with the above, you must meet the following requirements to qualify for a work permit:

  • Satisfy an immigration officer that you will leave Canada (you do not intend to immigrate)
  • Have no record of criminal activity. Police Clearances from your home country may be requested.
  • Provide evidence of financial resources to maintain yourself and family in Canada and to return home
  • Have good health. Medical Examinations may be requested.

Will my spouse be able to work in Canada?

Under Canadian Immigration rules and regulations, spouses and dependents are not allowed to work unless they apply for their own work permit through the Citizenship and Immigration Canada (CIC).

What if my situation changes in Canada?

It is imperative that you keep the CIC informed of any change in employment such as:

  • A change in jobs
  • An extension is required
  • A need to change jobs

Are there any conditions on my work permit?

An immigration officer may impose, vary or cancel conditions when issuing a work permit. The restrictions may include the following:

  • Type of employment you are allowed to take
  • The employer for whom you may work
  • Where you may work
  • How long you may continue to work

How many extensions of my work permit am I allowed?

There is no set limit on the number of extensions allowed. However, each extension will be evaluated on its merit and the government fees will always be applicable.

Will a work permit lead to permanent residence?

No, a work permit will not lead to residency. It is only for temporary employment and is not designed or intended to guarantee a long-stay in Canada. These are granted for a short period of time and evaluated on a case-by-case basis. However, if you are a live-in caregiver in Canada, you are allowed to apply for permanent residency after two years of full-time employment in Canada. Ask our immigration lawyer about the Live-in Caregiver Program.

How long does it take to process a work permit application?

Processing times, after the position has been confirmed by the Human Resources Development Canada (HRDC), is 2-4 weeks for a work permit. However, if medicals are required the time may be increased to 8-10 weeks. If you are in the IT field or a tool/die/machinist willing to live in Ontario, your application can be expedited, ask our immigration lawyer for more information about this.
